Privacy policy in „MIG-MARKET” OOD

Scope, purpose and legal basis of the procedure

“MIG-MARKET” OOD respects the privacy of employees, subcontractors, suppliers, contractors, guests, customers and other natural persons with whom the company wishes or has established business contacts, while guaranteeing the maximum protection of their personal data.
This Policy is prepared and based on Regulation (ЕС) 2016/679 (GDPR), the Personal Data Protection Act its subordinate act.
The policy is applicable to your personal data if you are a natural person or a representative of the abovementioned legal entities and will explain to you what personal information we process, for what purposes we use it and what your rights are.
The policy concerns only adults aged 18. Reservations and other services ARE NOT PROVIDED to minors.

Basic principles in GDPR

  • personal data are processed lawfully, fairly and transparently;
  • personal data are collected for specific, explicit and legitimate purposes in accordance with applicable law and are not further processed in a manner inconsistent with these purposes;
  • personal data are appropriate, relevant and limited to what is necessary in relation to the purposes for which they are processed;
  • personal data are accurate and, if necessary, kept up-to-date;
  • personal data shall be kept in a form that permits the identification of the persons concerned for no longer than is necessary for the purposes for which the personal data are processed;
  • personal data are processed in a way that ensures an adequate level of security of personal data, including protection against unauthorized or unlawful processing and against accidental loss, destruction / damage or theft, by applying appropriate technical or organizational safeguards;

Who processes and is responsible for your personal data

“MIG-MARKET” OOD is a trade company registered in the Commercial Register at the Registry Agency under UIC 813208824, which collects, processes and stores your personal data under the terms of this Privacy Policy.

What personal data we collect

“MIG-MARKET” OOD processes the following categories of personal data:

  • basic identification data;
  • data to be provided when concluding, modifying and terminating a contract relationship;
  • data to be provided when filling in the forms for online reservations;
  • data on payments, invoices, and other current liabilities;
  • communications data, including e-mail, letters, appeals, requests, complaints, and other feedback we receive from you;

Depending on the specific purposes and reasons, we process the data above either individually or in combination.
All personal data is collected, processed, stored only if there are legal grounds for doing so.

For all other cases, “MIG-MARKET” OOD processes personal data provided only with the explicit written consent (declaration) of the person for their provision and the purpose for which they are needed.

Third parties’ categories who access and process your personal data:

Processing personal data under contract with “MIG-MARKET” OOD have direct / indirect access to your personal data.

  • Transportation / courier companies to fulfill the obligations on delivery of paper documents and / or purchased goods;
  • Companies / Persons who, by assignment, support equipment, software and hardware, used for the processing of personal data and necessary for performing various services of accounting, payment of services and goods, technical support;
  • Companies / Persons performing installation and / or maintenance activities for the service delivery address;
  • Banks serving the payments made by you;
  • Persons performing consultancy services in different spheres.

Other personal data controllers to whom we provide your personal data who processing your data on our own and on our behalf.

Competent authorities under the law shall have the power to require “MIG-MARKET” OOD to provide information, including personal data such as judicial authorities, state and municipal administration authorities, various supervisory / regulatory bodies, registers and others.;

How long your personal data is stored

The length of time that your personal data is stored depends on the processing purposes for which it was collected:

Personal data processed for the conclusion / amendment and implementation of contractual relations are stored for the duration of the contract and final settlement of all financial relations between the parties;

Personal data processed for the purpose of issuing accounting / financial records for tax and social security controls, including but not limited to – invoices, debit notes, credit notes, delivery reports, service contracts are kept for at least 5 years after the expiration of the limitation period for the repayment of the public claim, unless the applicable law provides for a longer period.

Wages for pay– 50 (fifty) years.

Video recordings – 60 (sixty) days of recording creation.

“MIG-MARKET” OOD may store some of your personal data for a longer period of time until the expiration of the respective limitation period for the purpose of protection against any claims by customers in connection with the execution / termination of a contract for the purchase of goods and / or the provision of services as well as for a longer term in the event of a legal dispute which has already arisen in connection with the issue up to its final settlement with a court / arbitration decision in force.

After the expiry of the storage periods, the data (hard copy or technical) that are not subject to submission to the National Archives Fund shall be destroyed – hard copies by shredding and technical data by deleting the appropriate files.

What are your rights in relation to the processing of personal data

With regard to your personal data you have the following rights:

  • to access your personal data and information of the kind we have included in this Policy with respect to the data in question. You may ask us if and for what purposes we process your personal data in a written application;
  • to request to delete, correct or block your personal data when they are inaccurate or should be supplemented or processing does not meet the requirements of the GDPR;
  • to object at any time against the processing of your personal data, provided there is a legal basis for doing so;
  • to withdraw your consent to the processing of your personal data when the processing is based on your Consent;
  • to be notified about the nature of the security breach of your personal data and what steps have been taken to resolve them.

Can you cancel the transfer of personal data “MIG MARKET” OOD

Yes. You may refuse to provide personal data, but it makes it impossible to contract with you.

Infringements. Infringement Notification

Security breaches of data occurs when personal data for which “MIG MARKET” OOD is responsible affected by security incidents as a result of which infringe the confidentiality, availability and integrity of personal data.

In the event of a personal data breach, “MIG-MARKET” OOD shall, without undue delay, notify the Commission for Personal Data Protection no later than 72 hours after it has become aware of the infringement.
